How to Operate a Gift Annuity Program During Tough Economic Times
Frank Minton, Planned Giving Services

During the past year the market value of the gift annuity reserves of many charities has dropped significantly, sometimes necessitating the transference of general funds to the reserve account, and certainly arousing increased concern about the risk inherent in gift annuities. Here have also been two recent reductions in gift annuity rates that some fear will make gift annuities less appealing to donors. Charities now confront the challenge of marketing gift annuities to increasingly cautious donors while implementing risk-control strategies. This session will first show why gift annuities need not be any less attractive to donors, and then explain how charities can learn the hard lessons of the past year and in the future operate their programs on a more sound basis.

Frank Minton is a thoroughly accomplished planned giving expert. Frank founded Planned Giving Services, a consulting firm that built an exceptional national reputation and was acquired by PG Calc in August 2005.

Before entering consulting in January 1991, he spent ten and one-half years with the University of Washington, where he served as Director of Planned Giving and Executive Director of Development. Previously he served as Senior Estate Planning Officer and Field Director at Northwestern University, and was for six years a professor at Muskingum College in Ohio. He received M.A. and Ph.D. degrees from the University of Chicago.

Dr. Minton has played a most critical role in shaping the planned giving industry as we know it today. He has served both as conference chair and President of the National Committee on Planned Giving, a nationwide organization of gift planning professionals. In 1992 he received its Distinguished Service Award. He is an extensively recognized expert on gift annuities and has served as Chair of the American Council on Gift Annuities. He has also received a CASE (Council for the Advancement and Support of Education) Distinguished Service Award, the David Donaldson Distinguished Service Award from the Planned Giving Group of New England, and was the first recipient of the Outstanding Development Officer Award from the Northwest Development Officers Association.

Eugenia Maish, Ohio State University

Building effective relationships with professionals and family members is an essential part of an effective gift planning program. This presentation demonstrates how this is done and how to make certain that distributions are correct and timely.

Eugenia M. Maish is a Development Officer in Planned Giving for The Ohio State University, focusing on trust, estate and life insurance gift administration as well as the stewardship of financial advisors.
 
A practicing paralegal since 1999, she previously worked in private laws firms in the probate, real estate and estate planning arenas. She started in the legal field in 1990 as a technical writer at the City Prosecutor’s Office, then in worked in Patient Relations/Risk Management, Decedent Affairs, Surgical Education, Corporate and Foundation Relations, and Trusts/Estates at The Ohio State University.
 
She has written articles and training manuals on probate administration, real estate, special needs advocacy, mediation, domestic violence, and medical education. A former board member of the Paralegal Association of Central Ohio and the Capital University Law School’s Paralegal Advisory Board and Alumni Board, she is now a member of NCPG, the Central Ohio Planned Giving Council and the Columbus and Ohio State Bar Associations.
 
Eugenia holds a Bachelor’s from Wake Forest University, a Masters from Miami University, and a paralegal certificate from Capital University Law School.

Making the Right Choice Between a Gift Annuity & a Charitable Remainder Trust

Clearly, a gift annuity is preferable in some situations and a CRT in others. However, the choice between the two is sometimes complicated by the bias that planned giving professionals may have for gift annuities, and the bias that estate and financial planning professionals may have for CRTs. With a better understanding of the applications of these two instruments and an appreciation of the perspective of other professionals, both groups can work collaboratively on what works best for the donor. This session will discuss situations when one or the other instrument would be more beneficial to the donor and charity and offer suggestions for navigating the differences that may arise between professionals.

What Allied Professionals Want to Know From Planned Giving Pro's & Pitfalls With Planned Gifts
Lisa McLaughlin, JD, Polsinelli Shughart, PC

Lisa D. McLaughlin is a Shareholder in the law firm of Polsinelli Shughart PC and a member of the firm’s Wealth Planning Law Group and Non-Profit Law Group. Ms. McLaughlin has over 28 years of experience and breadth of knowledge in the estate planning field, employing the full range of sophisticated planning techniques to customize estate plans for clients. Ms. McLaughlin also advises clients and tax-exempt entities with respect to creation, administration and governance of charitable trusts, private foundations and other nonprofit entities as well as individual gifting to such entities and establishment of planned giving programs. Her practice also includes fiduciary litigation matters. Lisa is a Fellow of The American College of Trust and Estate Counsel, listed in The Best Lawyers in America for Wealth Planning, listed among the Top 50 Women Attorneys for 2008 in Missouri & Kansas Super Lawyers, and was named a Five Star Best in Client Satisfaction Wealth Manager by St. Louis Magazine in 2008. Lisa has been active in and is past chair of the Metropolitan St. Louis Probate and Trust Section and Nonprofit Law Committee, is currently Chancellor of the Missouri Annual Conference of the United Methodist Church, Director of the Missouri United Methodist Foundation, Barnes-Jewish Hospital Foundation-Chair Planned Giving Cabinet, Past President of the St. Louis Estate Planning Council and Past Board Member of the St. Louis Planned Giving Council. She received her A.B. from Duke University, magna cum laude, in 1978, and her J.D. from Vanderbilt University School of Law in 1981.
